RE: The tariff classification of a glass tumbler from China

Dear Ms. Rowe:

In your letter dated March 11, 2010, you requested a tariff classification ruling regarding a glass tea tumbler.

A sample was submitted with your ruling request. The sample will be returned to you in accordance with your request.

The product is approximately 7.25 inches tall. A stainless steel strainer is included in the glass tumbler. The product has a polypropylene lid.

You indicated that the unit value of the product is over thirty cents but not over three dollars.

Ms. Sims of your office advised us that the tumbler is used as a drinking glass. She indicated that the product does not consist of specially tempered glass and does not consist of glass-ceramics.

The product is a travel drinking glass/holder for hot tea.

The applicable subheading for the glass tea tumbler (including strainer and lid) will be 7013.37.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…other drinking glasses, other than of glass-ceramics: other: other: valued over thirty cents but not over three dollars each. The rate of duty will be 22.5 percent ad valorem.     Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
